Summary (plain English): These terms govern your use of Velocity Training’s websites and courses. Don’t share your login, don’t copy or redistribute materials, and follow the rules of good conduct. If you break the rules, we may suspend or terminate access without refund. For details, read each section below.

1) Who we are

Velocity Training Education Solutions, LLC (“Velocity Training,” “we,” “us,” or “our”) provides online and classroom training for pipeline inspectors and related professionals.

2) Acceptance of these Terms

By accessing or using our sites, courses, downloads, or any related services (collectively, the “Services”), you agree to these Terms of Service (“Terms”) and all policies referenced here (e.g., our Privacy Policy and Refund Policy). If you do not agree, do not use the Services.

3) Eligibility & accounts

You must be at least 18 years old (or the age of majority in your jurisdiction). If under 18, written parental/guardian consent is required before enrollment.
You must provide accurate information and keep it up to date.
Account security: You are responsible for all activity under your account. Keep your password confidential and notify us immediately of any unauthorized use.
No sharing: Accounts, passwords, course content, and practice test materials may not be shared, transferred, or resold. Access is for the single, named registrant only.

4) License to use the Services

Subject to these Terms and timely payment, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services and training materials during your purchased access window (e.g., 30/60/90/120 days, classroom dates, etc.).

Prohibited: copying, reproducing, screen-recording, scraping, downloading, distributing, publishing, selling, framing, or creating derivative works of our courses, questions, answers, feedback, videos, documents, or any part of the Services without express written permission.

5) Intellectual Property (IP)

All content in the Services—including text, questions, explanations, videos, graphics, logos, trade dress, and documents—is owned by Velocity Training or its licensors and protected by U.S. and international IP laws. No rights are granted except as expressly stated.

Protective actions: We may monitor suspected misuse, watermark materials, throttle suspicious activity, and immediately revoke access (without refund) for violations. We reserve all legal remedies, including injunctive relief and damages for unauthorized copying, sharing, or redistribution.

6) Acceptable Use

Use the Services lawfully and respectfully; do not harass, threaten, or disrupt learning environments.
No automated access (bots, scrapers, crawlers) or activities that burden or interfere with the Services.
No reverse engineering, security testing, or circumvention of access controls.
Academic integrity: Do not attempt to obtain or share exam materials, answer keys, or protected content from the Services or other users.
No impersonation, false identity, or misrepresentation of qualifications or affiliations.

7) Payments, access windows & refunds

Prices, access durations, and inclusions are shown at purchase. Taxes may apply.
Access begins when your order is fulfilled or on the course start date (for classroom offerings).
Chargebacks: opening a card dispute without first contacting support may result in immediate account suspension.
Refunds are governed by our Refund Policy. Where permitted, refunds are returned to the original payment method only.

8) Third-party platforms

Some Services run on third-party platforms (e.g., the LMS). Those platforms have their own terms and privacy practices. Your use of those platforms is subject to their terms in addition to ours.

9) Suspension & termination

We may suspend or terminate access immediately (with or without notice) for violations of these Terms, suspected fraud, security risk, or nonpayment. No refund is due if you are removed for violating the Terms, including content sharing or account sharing.

10) Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

11) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VELOCITY TRAINING AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF PROFITS, GOODWILL, DATA, OR REVENUE; OR COST OF SUBSTITUTE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

12) Indemnification

You agree to defend, indemnify, and hold harmless Velocity Training and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your use of the Services or your violation of these Terms or applicable law.

13) Force majeure

Neither party is liable for delays or failures caused by events beyond reasonable control (including natural disasters, war, acts of government, labor disputes, internet or hosting failures, or platform outages). Obligations are suspended for the duration of the event.

14) DMCA & reporting

If you believe content infringes your copyright, email [email protected] with: (i) your contact details; (ii) identification of the work; (iii) the infringing material and its location; (iv) a statement under penalty of perjury that you have a good-faith belief use is not authorized; and (v) your signature. We may remove or disable access to allegedly infringing material.

15) Privacy

Your use of the Services is also governed by our Privacy Policy.

16) Changes to the Services or these Terms

We may update the Services and these Terms from time to time. Changes take effect upon posting. Material changes will be highlighted on this page or communicated by reasonable means. Continued use after changes means you accept the updated Terms.

17) Governing law, venue & disputes

These Terms are governed by the laws of the State of Tennessee, USA, without regard to conflict-of-laws rules. The exclusive venue for any action not subject to informal resolution or small-claims court shall be state or federal courts located in Tennessee, and you consent to their jurisdiction. You and we each waive any right to a jury trial to the fullest extent permitted by law.

18) Non-discrimination

Velocity Training admits students without regard to race, gender, sexual orientation, religion, creed, color, national origin, ancestry, marital status, age, disability, or any other factor prohibited by law. Some offerings may require participants to be 18+ or to secure parental consent.
